A teacher victim of homophobia denounces the inaction of the National Education, the rectory denies and condemns the allegations

A professor at the Jean Lurçat high school in Perpignan has been fighting for 8 years against what he considers to be the administrative silence of National Education. Victim of ridicule, insults and homophobic acts by one of these companions, he asks for sanctions against her, in vain. However, she was convicted twice by justice.

The case takes place at the Jean Lurçat high school in Perpignan. It begins in 2014, when a teacher is the victim of bullying from a classmate because of their sexual orientation.
Worse, this malicious outburst is broadcast in front of the students of the establishment, which is currently being embellished with homophobic and abusive comments.

“Month after month, the acts of harassment increased. And I began to isolate myself. (…) I heard insulting comments on my back. Some called me Madame.”

In affidavits sent to the courts, several alumni claim that the bullying teacher used the term “DB“and referred to his class as”the PD room“.

The harassed teacher says that since then he has experienced a real descent into hell … He is disappointed by his hierarchy.

However, he won his civil lawsuit in April 2019. The Spanish teacher behind the allegations was sentenced to 4,000 euros in damages. The judge retains the “will to hurt” and behavior “in contradiction to what is expected of an educator.” The following year, this first sentence was upheld by the Montpellier Court of Appeal.

Between 2016 and 2019, the man says he is still a victim of harassment and intimidation. At work he receives anonymous letters, his car is vandalized, especially with insulting labels.
He even explains that a National Education inspector, during a career meeting, would have feminized his role by calling him a “teacher.”

For him, his hierarchy is guilty of slowness, of having abandoned him or even of inaction.

“In the face of the inaction of my superiors, I had to lead the fight in court myself. And today, this situation turns against me.”

For his lawyer, Me Camille Manya, the National Education that “He’s always been aware of the facts from the start, he’s done absolutely nothing.”. And the teacher at the origin of the harassment did not have an “academic sanction” at the height of her crime recognized and convicted by justice.
Hence his decision to initiate a new action before the administrative court of Montpellier.

In a press release, dated March 31, 2022, the communication department of the rectory of the Montpellier academy says “he cannot accept the accusations of inaction made against him.” He justifies his positions, his actions and says that he is following this harassment file “with the greatest attention since 2016”.

“In 2016, the human resources department became aware of this harassment situation. Since then, it has been accompanying and supporting the teacher.”

Press release from the Rector’s Office of the Montpellier Academy.

To demonstrate its commitment and support, the Rectorate specifies: “The professor initiated legal proceedings for which the academic services provided him with the legal protection of the civil servant to accompany and support him in his approach, in particular by taking charge of his legal fees. An administrative investigation was launched in 2017. In the end, steps were taken to remove the two affected teachers from the facility.

And to conclude: “Academic services remain at your disposal and will receive you again if the need arises. The follow-up of this file is therefore still relevant to the services, in parallel with the ongoing judicial process. In addition, the Jean Lurçat Institute remains very mobilized to fight against all forms of discrimination..

However, according to our colleagues at France Bleu Roussillon, So far, Educació Nacional has not taken any action against the Spanish teacher, despite her court conviction. Eight years after the events, the interested party received only a simple letter of rethinking to ask for it. “adopt in the future a positioning in line with [ses] obligations of the teacher“.

In addition, an internal administrative consultation in January 2017 concluded “that it would be desirable in the interest of the service to transfer the teaching staff in order to restore a serene climate for teachers and students ”.

The case was brought before the Ombudsman after a one-year examination, in July 2021, with conclusive conclusions.
For the Ombudsman “the administration should, as soon as it became aware of the controversial facts, at least since 2016, initiate a disciplinary proceeding against it, which would have avoided giving the impression of trivializing the facts thus reported.“.

Today, backed by SOS-Homophobia, the victim is demanding compensation and real sanctions against “his attackers”.

My dearest wish is to be able to work again in a serene climate, protected from any possible aggression. And to be rehabilitated in my duties and in my honor“.

Above all, the teacher hopes to be able to turn the page on this painful and long adventure.
